Florida probate judge LARRY SEIDLIN has set a hearing for 9:30 a.m. tomorrow to determine whether ANNA NICOLE SMITH’s body will be released to her partner HOWARD K. STERN, or her estranged mother, VIRGIE ARTHUR.

In a hearing earlier today, the spirited judge declared, “This body belongs to me,” and told lawyers representing both sides that they would “see a lot of each other” because he was planning to take his time in deciding the fate of Anna Nicole’s body.

The judge stated that it was his opinion that there was no rush in releasing the body, saying, “The body is in cold storage … it won’t decompose so fast … I can go over there now and look at it, there’s no rush, I am not rushing, I’m crossing every ‘T’ and dotting every ‘I’.”

The judge also noted that he knew little about the blonde bombshell before taking the case, saying, “I know nothing about this woman; my wife gets into it, I don’t get into it.”

Arthur, who flew to her daughter’s home in the Bahamas on Friday to check on the welfare of five-month-old Dannielynn, has hit back at Smith’s companion Howard K. Stern for denying her access to the baby.

And the former policewoman insists the baby’s real father is photographer Larry Birkhead.

She tells Good Morning America, “(Stern) won’t talk to me. I saw him on TV and he said, ‘You’ll never see her (Dannielynn) as long as I’m alive.’

“I think Larry Birkhead is the father. I don’t have a problem with (Dannielynn) being with Larry Birkhead; I do have a problem with her being with Howard Stern.”

Arthur, who was estranged from her daughter, insists she doesn’t want custody of the baby, she just wants to make sure she is properly looked after.

She adds, “I don’t want possession of her; I want to know if she’s in a safe place. I want them to do a DNA test and I want her to be put with her father.”

Arthur denies reports she’s interested in the millions of dollars her granddaughter could possibly inherit, adding, “The money has nothing to do with that baby.

“If Howard wants the money, give him the money. Just give us the baby.”

We’ve confirmed that Virgie Arthur has hired Coral Gables attorney Stephen Tunstall to secure the body. But there’s a catch: There are two outstanding California court orders preventing burial. A judge has put a hold on the release of the body; a second order demands a DNA sample from Smith.

We’re told Larry Birkhead’s lawyer, Debra Opri, will ask a Miami court to “domesticate” both orders from the California court. If granted, the orders would have full force and effect in Florida. We’re told Opri is making the requests in Florida today and tomorrow.

But there’s a twist. We’re told Birkhead has no objections to releasing the body, provided he gets a DNA sample sent to the lab he selected. For some reason, we’re told Stephen Tunstall has not agreed to release the DNA to Birkhead’s lab.

Denk, who was Anna Nicole’s bodyguard for two years, first met the supermodel when he was cast as the chef on “The Anna Nicole Show.”

“I think it was an instant spark, and I think for her it was the same,” he said.

Denk claims he and Anna had a passionate love affair that lasted for two years.

“She was wonderful,” he insisted. “A very sensitive and emotional woman. A very good kisser, I must say.”

But Alexander told “Extra” that he knew Anna was in trouble the last time he talked to her two weeks ago, a conversation that now haunts him.

“She was sick of being called names,” he said. “Everyone was bashing on her and calling her names and putting her down and suing her.”

Now, only on “Extra,” Denk breaks this stunning secret about Anna’s health that could affect the investigation into her death. He claims the reality TV star suffered from life threatening seizures, for which she was on medication.

But Denk does not believe drugs were to blame for Anna Nicole’s death.

“My opinion, I don’t think so,” he told us. “I think she was exhausted.”

Then, Denk dropped the baby bombshell we never saw coming. When asked if Smith ever revealed to him the real father of Dannielynn, Denk responded, “She always told me she wanted to have her kids with me.”

So is there a possibility Denk is Dannielynn’s father?

“There’s always a possibility,” he insisted.

Alexander hired prominent Beverly Hills attorney Cyrus Nownejad, and he made it clear he wants to raise Baby Dannielynn if she is his.

But for now, his thoughts are with his lost love.
